Terms of Service

Welcome to Beekoozy. These Terms of Service ("Terms") govern your access to and use of the Beekoozy website, mobile applications, and services (collectively, the "Platform"), operated by Beekoozy ("Beekoozy," "we," "us," or "our"). By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree, do not use the Platform.

1. About Beekoozy

Beekoozy is an online marketplace that connects hosts who offer short-term rental properties with guests seeking accommodations. Beekoozy also operates a paid Provider Directory that allows local service businesses ("Providers") to list and advertise their services to the short-term rental community.

Beekoozy is not a party to any rental agreement between a host and a guest. We do not own, manage, control, or operate any listed property. Hosts and guests contract directly with each other. Beekoozy's role is to facilitate the connection.

2. Eligibility

You must be at least 18 years of age to create an account and use the Platform. By using Beekoozy, you represent and warrant that you are 18 or older, have the legal capacity to enter into a binding agreement, and are not prohibited from using the Platform under applicable law.

3. User Accounts

You must create an account to access most features of the Platform. You agree to provide accurate, current, and complete information during registration and to keep your account information updated. You are solely responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.

You agree to notify us immediately at info@beekoozy.com if you suspect unauthorized access to your account. Beekoozy is not liable for losses resulting from unauthorized use of your account.

Beekoozy offers three account types:

• Host: Lists short-term rental properties on the Platform.
• Guest: Books and stays at properties listed on the Platform.
• Provider: Lists a local service business in the Beekoozy Provider Directory under a paid subscription.

4. Host Terms

4.1 Listing Your Property

By creating a listing, you represent that you have the legal right to rent the property, that the listing information is accurate, and that the property complies with all applicable laws, regulations, zoning rules, HOA guidelines, and local short-term rental ordinances.

4.2 Platform Fees

Beekoozy charges a platform service fee on completed bookings. As a launch promotion, hosts enjoy a 0% platform fee for their first three (3) months on the Platform. After the promotional period, a 12% platform fee applies to each completed booking. Beekoozy reserves the right to modify its fee structure with reasonable advance notice to hosts.

4.3 Security Deposits & Guest Protection

Hosts may require a security deposit and may optionally require guest insurance at their discretion. Hosts are solely responsible for setting deposit amounts and for the handling and return of deposits in accordance with applicable law.

4.4 PremiumHost Program

Eligible hosts may participate in the Beekoozy PremiumHost rewards program, which may include benefits such as loyalty credits, discounts, and promotional features. Program terms, eligibility requirements, and benefits are subject to change at Beekoozy's sole discretion.

5. Guest Terms

By booking a property, you agree to all house rules established by the host, including but not limited to check-in and check-out times, pet policies, smoking policies, and maximum occupancy. You agree to treat the property and its contents with care and to leave the property in the condition in which you found it.

Guests are responsible for any damages caused during their stay beyond normal wear and tear. Beekoozy is not responsible for resolving disputes between hosts and guests, though we may provide limited mediation assistance at our discretion.

PremiumGuest: Guests who meet Beekoozy's trust and verification criteria may be eligible for PremiumGuest status, which may provide additional benefits and visibility to hosts.

6. Reviews

Beekoozy operates a mutual review system where hosts and guests may review each other following a completed stay. Reviews must be honest, accurate, and based on firsthand experience. Reviews must not contain false statements, discriminatory language, personal attacks, or content that violates these Terms.

Beekoozy employs a host-protective review policy: if a guest does not submit a review within ten (10) days of checkout, the host automatically receives a default five-star (5★) rating for that booking. This policy is intended to protect hosts from unreviewed stays affecting their overall rating.

Beekoozy reserves the right to remove reviews that violate these Terms or our community guidelines, but is not obligated to do so.

7. Add-Ons and Bundled Services

Hosts may offer optional add-on services and experiences (such as pool heating, early check-in, pet fees, equipment rentals, and activity bundles) as part of their listing. These add-ons are arranged and fulfilled directly by the host or a third-party provider. Beekoozy does not warrant the quality, safety, or availability of any add-on service and is not liable for any issues arising from such services.

8. Provider Directory & Subscriptions

8.1 Provider Listings

Service providers may pay to be listed in the Beekoozy Provider Directory. By creating a Provider account, you represent that your business is legitimate, licensed (where required), and that all listing information is accurate and not misleading.

8.2 Subscription Billing

Provider Directory listings are offered on an annual subscription basis. Subscription fees are billed in advance and are processed securely through Stripe. The applicable fee is calculated based on the number of service area cities selected at the time of enrollment. By subscribing, you authorize Beekoozy to charge the applicable fee to your designated payment method.

8.3 Cancellation & Refunds

Provider subscriptions are non-refundable except as required by applicable law or at Beekoozy's sole discretion. If you cancel your subscription, your listing will remain active until the end of the current paid subscription period, after which it will be deactivated. No prorated refunds are issued for partial subscription periods.

8.4 Subscription Renewal

Subscriptions automatically renew on an annual basis unless cancelled before the renewal date. You will receive advance email notice before your subscription renews. You may manage or cancel your subscription at any time through the Beekoozy Provider Dashboard or Stripe Billing Portal.

9. Payments & Billing

All payment transactions on the Platform are processed by Stripe, Inc., a third-party payment processor. By submitting payment information, you agree to Stripe's Terms of Service and Privacy Policy. Beekoozy does not store your full payment card details.

All fees are stated in U.S. dollars unless otherwise noted. You are responsible for any applicable taxes associated with your use of the Platform. Beekoozy reserves the right to update pricing with reasonable advance notice.

10. Affiliate & Referral Program

Beekoozy may operate an affiliate or referral program through which approved affiliates earn commissions for referred subscriptions or sign-ups. Affiliate participation is subject to separate affiliate agreement terms. Beekoozy uses Rewardful to track affiliate referrals. Abuse of the affiliate program, including self-referrals or fraudulent activity, will result in immediate disqualification and may result in account termination.

11. Prohibited Conduct

You agree not to:

• Post false, misleading, or fraudulent listings or reviews;
• Use the Platform for any unlawful purpose or in violation of any applicable law or regulation;
• Harass, threaten, or discriminate against any user based on race, color, religion, national origin, sex, sexual orientation, disability, or any other protected characteristic;
• Circumvent or attempt to circumvent Beekoozy's platform fees by arranging off-platform bookings with users you met through Beekoozy;
• Scrape, crawl, or use automated tools to access the Platform without written permission;
• Introduce malware, viruses, or harmful code into the Platform;
• Impersonate another person or entity or create false accounts;
• Collect or harvest other users' personal information without their consent.

12. Intellectual Property

All content on the Platform created by Beekoozy — including but not limited to the Beekoozy name, logo, design, text, graphics, and software — is the property of Beekoozy and is protected by applicable intellectual property laws. You may not use, reproduce, or distribute any Beekoozy intellectual property without our prior written consent.

By submitting content to the Platform (such as listing photos, descriptions, or reviews), you grant Beekoozy a non-exclusive, royalty-free, worldwide license to use, display, reproduce, and distribute that content in connection with the Platform and our marketing efforts.

13. Disclaimers

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. BEEKOOZY DOES NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

BEEKOOZY IS NOT RESPONSIBLE FOR THE CONDUCT OF ANY HOST, GUEST, OR PROVIDER ON OR OFF THE PLATFORM. BEEKOOZY DOES NOT ENDORSE ANY LISTING, HOST, GUEST, PROVIDER, OR THIRD-PARTY SERVICE AND MAKES NO REPRESENTATIONS ABOUT THE QUALITY, SAFETY, OR LEGALITY OF ANY PROPERTY OR SERVICE LISTED ON THE PLATFORM.

14. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, BEEKOOZY AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING FROM YOUR USE OF OR INABILITY TO USE THE PLATFORM.

IN NO EVENT SHALL BEEKOOZY'S TOTAL LIABILITY TO YOU EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID BEEKOOZY IN THE TWELVE (12) MONTHS PRIOR TO THE CLAIM OR (B) ONE HUNDRED U.S. DOLLARS ($100.00).

15. Indemnification

You agree to defend, indemnify, and hold harmless Beekoozy and its officers, directors, employees, and agents from any claims, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the Platform; (b) your violation of these Terms; (c) your listing, booking, or content; or (d) your violation of any third party's rights.

16. Termination

Beekoozy reserves the right to suspend or terminate your account and access to the Platform at any time, with or without cause and with or without notice, if we believe you have violated these Terms or for any other legitimate business reason. You may terminate your account at any time by contacting us at info@beekoozy.com.

Sections that by their nature should survive termination shall survive, including Sections 12 (Intellectual Property), 13 (Disclaimers), 14 (Limitation of Liability), 15 (Indemnification), and 17 (Governing Law).

17. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the United States. Any dispute arising out of or relating to these Terms or your use of the Platform shall first be submitted to good-faith negotiation. If the parties are unable to resolve the dispute through negotiation, it shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. You waive any right to participate in a class-action lawsuit or class-wide arbitration.

18. Changes to These Terms

Beekoozy reserves the right to update these Terms at any time. We will notify you of material changes by email or by posting a prominent notice on the Platform. Your continued use of the Platform after any changes constitutes your acceptance of the updated Terms. We encourage you to review these Terms periodically.
